Australia Student Visa New Rules 2026: Onshore Applications and Dependant Changes

The Australia student visa new rules 2026, effective from 2 October 2026, introduce important changes for international students and their families.

The changes affect applications for the Student visa (subclass 500) and Student Guardian visa (subclass 590). They change who can apply while in Australia and when partners or dependent children can be included.

If you are planning to study in Australia, apply for another Student visa or bring your family, understanding these requirements can help you plan your next steps. Eligible international students can still apply for a Student visa.

What Are the New Australia Student Visa Rules?

The main changes concern:

  • Onshore applications: Many temporary visa holders must apply from outside Australia.
  • Further Student visas: Current Student visa holders generally need an exemption to apply again while in Australia.
  • Family members: Partners and dependent children can generally be included only where an exemption applies.
  • Subsequent entrants: Family members can no longer join through a later Student visa subsequent entrant application after the student’s visa is granted.

These changes make early planning particularly important for students considering further study or relocating with their family.

Can You Apply for a Student Visa While in Australia?

Under the new rules, many temporary visa holders cannot lodge a Student visa or Student Guardian visa application from inside Australia.

Affected applicants must be outside Australia when they apply and when their visa is granted.

This means entering Australia on another temporary visa does not necessarily allow you to switch to a Student visa onshore. Your eligibility depends on your current visa and the requirements that apply to your circumstances.

What About Current Student Visa Holders?

Current Student visa holders applying for another Student visa are also affected unless they qualify for an exemption.
A person holding a Student visa as a dependant who wants to become the primary student applicant must generally apply from outside Australia.
However, these changes do not automatically cancel an existing Student visa.

Student Visa Extension Australia: Who Can Apply Onshore?

Some current Student visa holders may still apply for another Student visa while in Australia.

Potential exemptions include students who:

  • Need up to 12 additional months to complete their studies with the same education provider.
  • Are sponsored by the Department of Foreign Affairs and Trade or Defence.
  • Are applying to study a PhD.
  • Are applying for primary or secondary school studies.
  • Have completed their main course and are progressing to a higher Australian Qualifications Framework qualification.
  • Have completed school studies and are progressing to a course without an AQF level.
  • Have completed a course without an AQF level and are progressing to one with an AQF level.
  • Cannot continue their course because their education provider has defaulted.

Each exemption has specific requirements. For example, students progressing from a completed higher education course must undertake another higher education course with a higher education provider.

Australia Student Dependent Visa Rules: Can You Bring Your Family?

From 2 October 2026, Student visa applicants generally cannot include a partner or dependent children unless an exemption applies.
This also affects applications for a further Student visa.

Who May Include Dependants?

An exemption may apply to students who are:

  • Studying a PhD.
  • Sponsored by DFAT or Defence.
  • Receiving a foreign government scholarship.
  • Eligible students from a Pacific country or an ASEAN member country.

Students who already have family members included in their current Student visa and are applying in Australia may also be able to include those family members in their next application.
The primary applicant and included family members must be in the same location when the application is lodged.

Can Your Spouse or Children Join Later?

Current Student visa holders can no longer add family members as subsequent entrants after their Student visa has been granted. Home Affairs states that there are no exemptions to this subsequent entrant restriction.

If you plan to study in Australia with your family, check eligibility before lodging your application.

What Happens to Applications Lodged Before 2 October 2026?

Student visa applications lodged before 2 October 2026 continue to be assessed under the rules that applied when they were lodged.
This includes earlier applications that included family members.
The lodgement date therefore matters when determining which requirements apply to an application.

What Should Students Check Before Applying?

Before enrolling, booking flights or making relocation arrangements, check:

  • Whether your current visa allows an onshore application.
  • Whether you qualify for a further Student visa exemption.
  • Whether your intended course meets the relevant requirements.
  • Whether your partner or children can be included.
  • Whether you must be outside Australia for lodgement and visa grant.

Checking these details early can help you avoid making study or travel commitments based on an unavailable visa pathway.
